    The court has this morning ordered by interlocutory decision that
ex-director P.F. of the former Industry & Supply division of Ballast Nedam is
liable to pay an amount of approximately EUR 20 million to Ballast Nedam N.V.
The court ordered also that several associated parties of P.F. are jointly
liable for a substantial part of the damage. This includes damage inflicted
as a result of fraud and forgery.

    The decision of the court is a interlocutory decision, which means that
only on a part of the claims the court has made a decision. The proceedings
will be continued en the court shall decided on the other claims in due time.

    In addition to the civil action, a criminal proceeding is still taking
their course. It is not possible at this stage to provide any further
information on the duration and likely outcome of the proceedings.

    In 2007, Mr. P.F. was already ordered to pay EUR 2 million by way of a
first advance on the compensation. This payment has been received in 2007 by
Ballast Nedam and has not been included in the income statements. Ballast
Nedam has secured payment of compensation as far as possible in the form of a
bank guarantee and attachment of and liens on assets belonging to those
involved. The outcome of the procedure has not been included in the 2009
profit forecast.
