NOTICE TO THE MARKET
CADE approval for the acquisition of Es Gás
a publicly-held corporation, headquartered in the city of Cataguases, State of Minas Gerais, at Praça Rui Barbosa, n.º 80 (part), Centro, CEP 36770-901, enrolled with the CNPJ under no. 00.864.214/0001-06 ("Company"), in compliance with the provisions of paragraph 4 of article 157 of Law no. 6,404, of December 15, 1976, as amended, and in CVM regulations, in particular CVM Resolution No. 44, of August 23, 2021, and CVM Resolution No. 80, of March 29, 2022, in continuity with the Material Fact disclosed on March 31, 2023 and the Notices to the Market disclosed on April 11, 2023 and April 26, 2023, announces to shareholders and the market in general that on this date, the Board Administrative for Economic Defense (CADE) published in the Federal Official Gazette the approval, without restrictions, of Concentration Act No. of the State of Espírito Santo - ES Gás by Energisa S.A., within the scope of the auction held on March 31, 2023, in accordance with the rules contained in the auction notice No. 01/2023.
This decision is still subject to appeal or judicial review of the concentration act for the term of 15 days as from publication in the Official Government Press. If no such appeal or review is filed within this period, the decision will become final and unappealable.
