Subject: Arbitration ruling on additional revenue share from roaming service

Reference is made to the dispute between Advanced Info Service Public Company Limited (AIS) and TOT Public Company Limited (TOT) submitted to the Arbitration Institute on 27 September 2018. Under the dispute, TOT claimed for additional revenue share from roaming service based on the 7thamendment to the main concession agreement for the period from July 2013 to September 2015 in total amount of Baht 16,252 million with a penalty interest rate of 1.25% per month.

On 11 February 2020, the Arbitration ruled in favor of AIS to dismiss TOT's claim, with the reason that AIS did not breach the agreement.

However, TOT is eligible to file a petition to the Central Administrative Court to revoke the Arbitration's ruling within 90 days after receiving the ruling. Should there be any further significant update, we will inform accordingly.
