Gentlemen: This refers to your letter requesting us to confirm the veracity of the information contained in the Manila Times (Online Edition) news article dated November 15, 2021 entitled "SNAP-Benguet appeals penalty", the relevant portion of which is quoted hereunder: "SN Aboitiz Power-Benguet, Inc. (SNAP-Benguet) has paid a P875,000 fine for exceeding an outage allowance but is still hoping that the Energy Regulatory Commission (ERC) will review its decision to penalize the firm. . . . . The ERC penalized SNAP-Benguet after its 34.5-megawatt (MW) Ambuklao Unit 1 incurred 14.3 unplanned outage days earlier this year, more than double the allowed 6.8 days for hydropower facilities. The firm paid the fine on November 8. . . . ." We confirm the information reported in the cited news article from Manila Times (Online Edition).
