AirAsia Berhad : Discontinuance Of Legal Proceedings By And Against AirAsia Berhad And Airasia X Berhad

Reference is made to the Company's announcements made on 11 December 2018, 23 January 2019, 18 July 2019, 10 September 2019, 8 March 2022 and 5 April 2022 on the suit filed by Malaysia Airports (Sepang) Sdn. Bhd. ("MASSB"), a wholly-owned subsidiary of Malaysia Airport Holdings Berhad ("MAHB"), against the Company's wholly-owned subsidiary, AirAsia Berhad ("AAB"), together with an affiliate of the Company, AirAsia X Berhad ("AAX"), in relation to MASSB's claim for Passenger Services Charges.

Reference is also made to the Company's announcements on 14 May 2019, 4 October 2019 and 28 March 2022 respectively in relation to the suit filed by AAB and AAX, where MASSB is named as the respondent, in relation to AAB's and AAX's claim for the sum of RM479,781,285.00.

The Company wishes to announce that pursuant to the Notices of Discontinuance filed on 9 August 2022, AAB and AAX have discontinued the following legal proceedings against MASSB:-

(1) Kuala Lumpur High Court Civil Suit No. WA-23NCvC-56-10/2019; and

(2) Federal Court Civil Motion Nos. 08(i)-200-04/2022(W); 08(i)-201-04/2022(W); 08(i)-202-04/2022(W); 08(i)-203-04/2022(W); 08(i)-204-04/2022(W) and 08(i)-205-04/2022(W).

Concurrent with the above, the Company also wishes to announce that:-

(1) pursuant to the Notice of Discontinuance filed on 9 August 2022, MASSB have discontinued Court of Appeal Civil Appeal No. W-02(IM)(NCvC)-600-04/2022 against AAB and AAX; and

(2) pursuant to the Notice of Discontinuance filed on 9 August 2022, MAHB and its subsidiary, MASSB, have discontinued Kuala Lumpur High Court Civil Suit No. No. WA-23CY-8-02/2019 against AAB, AAX, Riad Asmat and Benyamin Bin Ismail which had been filed on 19 February 2019.

With the filing of the aforesaid Notices of Discontinuance, the Company is pleased to announce that these legal proceedings between AAB and AAX and MAHB and MASSB have been discontinued.
