LIQUIDITY COMPANIES - ACQUITTAL OF ATENOR AND ITS MANAGEMENT - CONFIRMED ON APPEAL

In today's ruling, the Antwerp Appeal Court confirmed the acquittal pronounced in January 2015 by the Criminal Court of Turnhout. This ruling closes thus definitively this case on its merits.

We remind you that ATENOR and three of the former and current members of its management team were implicated in this case which concerned the acquisition by the Belgian branch of the French company SOCIETE GENERALE of 18 companies, including ENTREPRISES MIGEOTTE SA, sold by ATENOR in 1999.

On completion of an in-depth analysis of the file, the Court in first instance acted the good faith of ATENOR and its managers, ruled that they had not committed any infringement and so acquitted them.

The prosecution however appealed this judgement.

After the definitive judgement of 4 May 2016 in the criminal proceedings in Brussels in the "TENSLEEP/D-FACTO" case, this is a second case in which the good faith of ATENOR and its management has been recognised.

We remind you that oral pleadings with respect to a similar case ("AMERICAN ENERGY") are currently ongoing before the Courts of Brussels.
