EBR & EBR.B; LATIBEX: XELT.O & XELT.B) hereby informs its shareholders and the market in general, in addition to the Market Announcement disclosed on March 16, 2021 and March 23, 2021, that Decree 10,670/2021 was issued, which provides for Eletrobras's qualification under the Program Investment Partnerships - PPI and its inclusion in the National Privatization Program - PND, to start the studies necessary to structure the Company's capitalization process.

The full text of the aforementioned decree is attached to this Announcement.

DECREE No. 10,670, DATED APRIL 8, 2021

Provides for the qualification of Centrais Elétricas Brasileiras S.A. - Eletrobras within the scope of the Investment Partnerships Program of the Presidency of Republic and its inclusion in the National Privatization Program.

The PRESIDENT OF THE REPUBLIC, in the exercise of the powers conferred by art. 84, heading, items IV and VI, letter "a", of the Constitution, and considering the provisions of art. 6, heading, item I, of Law No. 9,491, dated September 9, 1997, in art. 4 and in art. 7, heading, item V, letter "c", of Law No. 13,334, dated September 13, 2016, and Resolution No. 167, dated March 16, 2021, of the Investment Partnership Program Council of the Presidency of the Republic,

DECREES:

Art. 1. Centrais Elétricas Brasileiras S.A. - Eletrobras is qualified, within the scope of the Investment Partnerships Program of the Presidency of Republic - PPI, and included in the National Privatization Program - PND, for the beginning of the studies necessary for the structuring of the capitalization process, according to the guidelines established in Provisional Measure No. 1,031, dated February 23, 2021.

Art. 2. The provisions of art. 47 and art. 59 of Decree No. 2,594, of May 15, 1998, does not apply to Eletrobrás.

Art. 3. In the event that Provisional Measure No. 1,031, of 2021 is not converted into law, Eletrobras' qualification, within the scope of the PPI, and its inclusion in the PND will lose its effects.

Art. 4. Are hereby revoked:

I - Decree No. 9.351, dated April 19, 2018; and

II - Decree No. 9.375, dated May 15, 2018.

Art. 5. This Decree comes into force on the date of its publication.
