FAIVELEY TRANSPORT : Arbitration Award

Faiveley Transport (Paris:LEY) headquarters announced the confirmation and enforcement in US of the arbitration award in favour of its subsidiary Faiveley Transport Malmö AB against Wabtec Corporation (U.S.A.) and the filing of a new claim in US seeking for additional damages from Wabtec Corporation.

The United States District Court for the Southern District of New York entered an Order on the 10^th of May 2010 granting Faiveley's motion to confirm and enforce the ICC Award issued on 21 December 2009 and rendered in the arbitration filed by Faiveley Transport Malmö against Wabtec Corporation with respect to the misappropriation by Wabtec of trade secrets on its brake components (tread brake units and disc actuators) and various breaches of contract under a terminated license agreement.

By the ICC Award, Wabtec is permanently enjoined from any use of Faiveley's manufacturing drawings and related documentation, with the exception of the limited use for the supply of products under contracts of Wabtec entered into before the termination of the license agreement. The Order entered by the U.S. District Court confirms the ICC Award. In addition, the U.S. Order permits Faiveley the opportunity to ensure Wabtec's compliance with the ICC Award in the U.S.

The ICC Award recognizes that additional Faiveley entities, other than Faiveley Transport Malmö have suffered damages due to the misappropriation of trade secrets that occurred on the US market. Such Faiveley entities filed a new complaint on the 14^th of May 2010 before the same U.S. court seeking for monetary relief for misappropriation of trade secrets, unfair competition, interference with prospective contractual relations, interference with economic advantage and unjust enrichment relating to Wabtec's use of Faiveley valuable confidential information in connection with families of products related to tread brake units and disc actuators.
