Notice on Filing Additional LawsuitUpdate and Progress of Disclosure Matter

As announced in the "Notice on Filing Lawsuit" dated May 21, 2021, Japan Display Inc. (JDI) had filed a lawsuit (the "Prior Lawsuit") in Kanazawa District Court against Hakusan-city, Ishikawa Prefecture, for a confirmatory judgment to the effect that it does not owe any obligation to the city to return a subsidy for constructing a plant (the "Subsidy"). JDI today filed an additional lawsuit for revocation of the administrative disposition (the "Additional Lawsuit") against Hakusan-city, Ishikawa Prefecture.

3. Background of Filing the Additional Lawsuit

JDI filed the Prior Lawsuit to confirm that it does not owe any obligation to return the Subsidy in response to the order of revocation of the decision to grant the Subsidy (Hakusan-city Mayor's Order No.96, dated on January 29, 2021; the "Revocation Order") and the order to return the Subsidy (Hakusan-city Mayor's Order No.97, dated on January 29, 2021; together with the Revocation Order collectively referred to as the "Orders").

On the first oral argument date of the Prior Lawsuit, Hakusan-city claimed that the Orders are administrative disposition and must be contested in an administrative lawsuit, not the Prior Lawsuit, without clarifying any specific legal grounds.

JDI's position is that the Orders do not fall under the category of administrative disposition, and the position remains unchanged. However, because any action to revoke the administrative disposition is subject to a short statute of limitation, JDI decided to file the Additional Lawsuit as a precautionary measure.

JDI's argument does not differ from that of the Prior Lawsuit, as disclosed in the "Notice on Filing Lawsuit" dated May 21, 2021.
