Munich, 24 October 2019 Independent expert intends to fully confirm Telefónica Deutschland's MBA MVNO pricing Today, the commissioned independent expert, a publicly appointed and sworn expert for business valuation, has informed us about his intention to confirm the prices stipulated in the MBA MVNO agreement for the capacity-based access of 1&1 Drillisch to the Telefónica Deutschland mobile network and thus to reject the retroactive reduction of prices as requested by 1&1 Drillisch. As part of the merger remedies for the acquisition of E-Plus in 2014, Telefónica Deutschland agreed to sell up to 30% of its used network capacity to a competitor without own network infrastructure and signed a corresponding so-called MBA MVNO agreement with Drillisch (today 1&1 Drillisch, majority owned by United Internet). This commercially negotiated contract foresees the right of 1&1 Drillisch to call for a pricing review. The intended decision applies to the specific pricing adjustment request for the period after September 2017. Further pricing reviews requested for periods from July 2018 onwards are currently ongoing. The announced confirmation of prices is still subject to the outcome of a separate proceeding concerning contributions to spectrum payments from the 2015 frequency auction, which Telefónica Deutschland has initiated. Telefónica Deutschland is further pursuing other claims against wholesale partners concerning a low triple-digit million amount, which includes the above-mentioned spectrum contributions. We expect these disputes to resolve in the course of 2020. We reiterate our full-year 2019 guidance as well as our mid-term targets. More Information:
