New York's top court is being asked that question
by animal rights group, the Nonhuman Rights Project
Happy is a 51-year-old Asian elephant
She's called the Bronx Zoo home since 1977
The Nonhuman Rights Project says Happy is
entitled to habeas corpus
And that Happy should be recognized as a
"person" under New York law
They want her moved to an elephant sanctuary
The Bronx Zoo says Happy is well cared for
and moving her would not serve her interests
Prior efforts to grant legal personhood
to animals have been unsuccessful
