Dear Sir/Madam,

With reference to the captioned matter, this is to inform you that an application seeking exclusion of the CIRP period under Section 60(5) of the Insolvency and Bankruptcy Code, 2016, read with Regulation 40C of CIRP Regulations was filed by the Resolution Professional before the Hon'ble National Company Law Tribunal, Mumbai Bench (Hon'ble NCLT), wherein, the Hon'ble NCLT vide its order dated 26 July 2022 (written copy of order received on 3 August 2022) allowed exclusion of 65 days from the CIRP period.

The copy of the Hon'ble NCLT order dated 26 July 2022 is attached herewith for your reference.

The above Application is filed by the Applicant/Resolution Professional for exclusion of CIRP period of 65 days i.e. from 28.12.2021 to 02.03.2022.

After hearing the submission of counsel appearing for the Applicant and upon perusing the material available on record, this Bench feels it is a fit case to allow the above Application.

Accordingly, the above I.A is allowed, granting exclusion of 65 days from 28.12.2021 to 02.03.2022 in terms payer clause (c).

With the above observations and directions, the above I.A is allowed and stands disposed of.

I.A. 238/2022

The above Application filed for exclusion / extension of CIRP period have become infructuous in view of allowing I.A. 638/2022. Accordingly, the above I.A. stands disposed of as infructuous.

I.A. 523/2022

Mr. Prakhar Tandon undertook to file Reply and Vakalatnama on behalf of the Respondent. Respondent shall file Reply and Vakalatnama within two weeks by serving advance copy on the other side failing which the Respondent's right to file Reply shall stands forfeited.

I.A. 1278/2022

The above application is filed for restoration of I.A. 1274/2021 which was dismissed for non-prosecution on 09.08.2021.

The above I.A. is allowed and the I.A. 1274/2021 is restored to file.

Mr. Sandeep Upadhyay undertook to file Reply and Vakalatnama on behalf of the Respondent i.e. Anand Rathi Global. Respondent shall file Reply and Vakalatnama within two weeks by serving advance copy to the other side, failing which the Respondent's right to file Reply shall stands forfeited.
