SMRT CLARIFIES THE FACTS SURROUNDING GOODWILL GESTURES GIVEN TO NITCHAREE PENEAKCHANASAK AND HER FAMILY

1. We refer to media reports over the past week on Miss Nitcharee Pen-eakchanasak , who was injured in an incident at Ang Mo Kio MRT Station on 3 April 2011, and would like to share what has transpired so far.

2. Following the incident, SMRT immediately began looking at how we could help Nitcharee and her family. We were mindful of the special circumstances surrounding the case: a young girl who was alone in Singapore was seriously hurt, and needed her family by her side as she sought to overcome the trauma and recuperate. The family had to travel to Singapore from Thailand to be with her. To facilitate this, we offered an initial financial support of $10,000, an amount that would adequately cover the expenses incurred during their travel and stay in Singapore.

3. This goodwill financial assistance was presented to Mr Kittanesh Pen-eakchanasak, Nitcharee’s father, in the presence of the Royal Thai Embassy officials, when we met him on

11 April. We also offered taxi services for Mr Kittanesh and his family members to use when

travelling in Singapore.

4. Our help was meant to be a goodwill gesture, not compensation. This was clearly indicated to Mr Kittanesh in our meeting. Mr Kittanesh accepted our offers of help.

5. As police investigations into the incident are still underway, the issue of compensation will not be addressed till the investigations have concluded.

6. Following an appeal by Mr Kittanesh through the Thai Embassy for further help, SMRT provided a further assistance of $5,000 in end May 2011. This was presented through the Thai Embassy. Once again, we highlighted the nature of our assistance – that it was for goodwill and not compensation, as the case was still undergoing investigations. Hence, it was to our surprise to find out through the media on 12 June 2011 that Mr Kittanesh had regarded this amount as compensation. We asked embassy officials to clarify and reiterate to Mr Kittanesh the purpose of our gestures.

7. On 17 June 2011, SMRT received a legal claim from Mr Kittanesh’s lawyers, asking for $3.4 million in compensation for the incident.

8. We have so far refrained from commenting on the facts of the case and kept discussions with Nitcharee and her family private and confidential so as to protect the family’s privacy. Owing to the recent news reports we now hope to clarify some of the comments made in the media.

9. This matter is now pending the outcome of police investigations and the court’s findings. The law firm of KhattarWong has been appointed to act for SMRT in this matter.
