IMDEX SUCCESSFULLY PROTECTS CORE SAMPLE ORIENTATION PATENT

IMDEX Limited ("IMDEX" or the "company"), a leading mining equipment, technology and services (METS) provider to the global minerals industry, today announces successful patent infringement proceedings brought in the Federal Court against Globaltech Corporation Pty Ltd and Globaltech Pty Ltd ("Globaltech").

On 26 November 2018, Besanko J ruled in favour of IMDEX subsidiaries, the Australian Mud Company Pty Limited (AMC) and Reflex Instruments Asia Pacific Pty Ltd (REFLEX). AMC and REFLEX are the patentee and exclusive licensee respectively of Australian Standard Patent no. 2010200162, entitled "Core Sample Orientation" ("Patent"). The Court made orders as follows:

  • Globaltech has infringed the Patent, including by supply of Orifinder orientation tools and the TruCore orientation tool that is distributed by Boart Longyear Limited ("BLY");

  • • The Court has certified the validity of the patent claims challenged by Globaltech;

  • • Globaltech has been ordered to pay the costs of AMC and REFLEX in full; and

  • • The Court has ordered an inquiry as to damages or profits in respect of the Globaltech's infringement of the patent.

Whilst injunctions against Globaltech and an order for destruction of Orifinder and TruCore tools have been made, these orders have been suspended temporarily to allow Globaltech time to formally apply for a stay pending its proposed appeal to the Full Court.

In response to the ruling, IMDEX's Managing Director, Bernie Ridgeway said:
