Chapter 11 trustee Mark C. Healy, of Latitude 360, Inc. filed a plan of liquidation with related disclosure statement in the US Bankruptcy Court on January 25, 2019. As per the plan filed, the Administrative Expense Claims shall be paid in full in cash. All fees and charges assessed against the Estate under Chapter 123 of Title 28, United States Code, 28 U.S.C. §§ 1911-1930, through the Confirmation Date, as determined by the Bankruptcy Court in the Confirmation Order, will be paid no later than 30 days after the Effective Date. Priority Wage Claim shall be paid on the Effective Date or as soon thereafter as reasonably possible an amount, in full in Cash. Priority Tax Claims shall be paid an amount, in Cash, equal to up to 100% of their Allowed Claims by the Liquidating Trustee out of the Causes of Action Recoveries on the Effective Date. Each Holder of an Allowed Unsecured Claim shall receive, in full and final satisfaction of such Holder’s Allowed Claim its Pro Rata Share up to 100% of its Allowed Claim, provided however that no payment will be made to any Holder of Allowed Unsecured Claim unless and until all Allowed Priority Tax Claims of Governmental Units have been paid in full. The Plan Proponent does not anticipate that any Holder of Allowed Unsecured Claim will receive a distribution under the Plan. Allowed Equity Interests will not receive a distribution under the Plan on account of such Equity Interests. The plan shall be funded by liquidating debtor’s estate.
