On 09.03.2022 the notice for the presidential ordinance formulated by Dumitrescu Andrei Sebastian was received at Oil Terminal S.A.'s headquarter, object of file no. 7054/118/2021/a1, with court hearing date on 15.03.2022 in Constanta Court.

By having consulted the Courts' Portal, we took notice of the presidential order content, object of file no. 7054/118/2021/a1, by which complainant Dumitrescu Andrei Sebastian requests Constanta Court to suspend the execution of Board of Directors' Decision no. 12/14.02.2022 and EGSM Convocation of 21/22.03.2022 until final settlement of file no. 7054/118/2021 pending before Constanta Court.

We remind that, on 28.02.2022, the presidential order formulated by complainant Dumitrescu Andrei Sebastian was received at Oil Terminal S.A.' headquarter, requesting Constanta Court to grant an order to suspend the execution of Board of Directors' Decision no. 12/14.02.2022 and EGSM Convocation of 21/22.03.2022 until final settlement of file having as object the finding of absolute nullity for the above-mentioned acts. We mention that on 08.03.2022, by Decision no. 284 pronounced in file no. 1292/118/2022/a1 Constanta Court rejected as groundless the presidential order formulated by Dumitrescu Andrei Sebastian concerning the suspension of execution for Board of Directors' Decision no. 12/14.02.2022 and EGSM Convocation of 21/22.03.2022 until final settlement of file of first instance no. 1292/118/2022.

File no. 7054/118/2021 has court hearing date set on 30.03.2022 and is concerned by the finding of absolute partial nullity for OGSM' Decision no. 2/26.04.2021 regarding art. 1 by which Oil Terminal S.A.' shareholders approved "2020 financial statements, issued according to International Financial Reporting Standards (IFRS), including: statement of financial position, statement of overall result, statement of change in equity, statement of cash flows, notes on financial statements, based on the Board of Directors' Report and on the auditor's Report"
