AS Tallinna Vesi lodged an appeal in cassation with the Supreme Court in a dispute concerning a damages claim against the Estonian Competition Authority

AS Tallinna Vesi lodged an appeal in cassation with the Supreme Court against the 19 June 2019 Tallinn Circuit Court's decision in administrative case 3-14-363. The appeal in cassation against the Tallinn Circuit Court's decision means that the dispute has not yet reached the final verdict.

The administrative case concerns AS Tallinna Vesi's complaint against the Competition Authority regarding the compensation for loss of tariff income as well as the complaints challenging the refusal to review AS Tallinna Vesi's applications for the approval of water tariffs for 2013-2017. Tallinn Administrative Court had dismissed the Company's claims with its decision dated 19 November 2018. AS Tallinna Vesi appealed the Administrative Court's decision on 19 December 2018. Tallinn Circuit Court dismissed the appeal on 19 June 2019.

The administrative case 3-14-363 is separate from the international arbitration proceedings that ended on 21 June 2019 where a majority of the arbitration tribunal decided to dismiss AS Tallinna Vesi´s and United Utilities (Tallinn) B.V.'s claims against the Republic of Estonia. In the arbitration proceedings, AS Tallinna Vesi and United Utilities (Tallinn) B.V. claimed compensation for damages based on the Agreement on Encouragement and Reciprocal Protection of Investments between the Kingdom of the Netherlands and the Republic of Estonia.
