Brazil's electricity regulator, Aneel, has decided to launch a forfeiture proceeding that could ultimately lead to the revocation of a concession held by a local Enel subsidiary in São Paulo.

In December, Energy Minister Alexandre Silveira urged Aneel to initiate proceedings to terminate Enel's concession after blackouts affected more than 2 million consumers in the São Paulo metropolitan area following extreme weather events.

The case now enters a new phase, during which Enel will have another opportunity to present its defense before the regulator decides whether to recommend the federal government revoke the concession.

The transition to this new stage of the proceedings prevents the automatic renewal of Enel São Paulo's contract, which is set to expire in 2028.

This would complicate a potential sale of the concession, the primary option previously utilized by companies facing similar situations in the power sector. Enel, however, has publicly stated that it has no intention of divesting the asset.

Enel was not immediately available for comment.
